1. WHO WE ARE

StaffDNA, LLC (“StaffDNA,” we,” “our” or “us”) is a trusted leader in the healthcare staffing space, and specializes in travel nurse, travel allied and permanent placement healthcare staffing solutions for public and private healthcare systems across the United States.  StaffDNA provides a publicly available website https://Staffdna.com, mobile applications, as well as several social media accounts (our “Sites”), where we provide information about our services, healthcare career opportunities and the healthcare staffing industry (our “Services”).

2. PERSONAL DATA WE COLLECT

We collect personal data from you through your use of the Sites and Services. Personal data is information that can be reasonably connected to an identified or identifiable individual.  It does not include deidentified or anonymized data.

3. TYPES OF PERSONAL DATA WE COLLECT

We collect the following types of personal data:

  1. Information You Provide To Us.  We may collect the following categories of personal data if you provide it to us:

    • Create an Account.  When you sign up for an account with us, we collect your contact information and identifiers (such as name, email addresses, phone numbers) and information regarding how you heard about us;
    • Sign In.  When you sign into your account, we collect your email address and password;
    • Creating a Profile.  When you create a profile with us, we collect your contact information, information regarding your professional background (resume, curriculum vitae, credentials, education history, degree type, employment history, specialty areas, areas of professional interest), as well as information on how you were referred to us;
    • Applying for Jobs.  When you apply for jobs, we collect your contact information, information regarding your professional background (resume, curriculum vitae, credentials, education history, degree type, employment history, specialty areas, areas of professional interest), as well as information on how you were referred to us;
    • Employment.  If you are employed by us, we collect information regarding your background and employment, preferences, contact information, and position information.
    • Contacting Us.  When you contact us, we collect your name, email address, subject of the message and any other information you provide to us.
    • Interacting on Social Media.  When you interact with us on social media, we may collect your social media account name and any information you send to us.

      You may use your account to access, correct or view certain personal data we have collected that is associated with your account.  To review or request changes to any of your personal data, contact us at privacy@staffdna.com.
  1. Information We Collect Via Tracking Technology.  We automatically collect certain personal data through use of our Sites and our use of cookies and other tracking technology, such as:

    • Usage Information. We collect information such as which areas of the sites you access, the frequency of access, and what you click on while using the sites.
    • Technical Information.  We collect technical information about your connection to our sites, including the Internet protocol (IP) address, browser type and version, browser plug-in types and versions.
    • Device Information. We collect information about the device you are using, such as hardware model, operating system, application version number.
    • Mobile Device Information. In addition to the device information listed above, when you access our sites on your mobile device, we collect and aggregate information about whether you are accessing the sites via a mobile device or tablet, device type, and carrier.
    • Location Information. We collect location information from site visitors on a city-regional basis.
    • Geotagging.  We also geotag onsite time entries as required by some employers/facilities.

  1. Personal Data From Other Sources.  We sometimes receive personal data about you from other sources, such as government entities, advertising networks, data brokers, operating systems and platforms, mailing list providers, social networks and advertising partners.

4. WHY WE COLLECT AND HOW WE USE YOUR PERSONAL DATA

We collect, process and use personal data to allow you to provide our Sites and Services to you. For example, we use personal data we collect to:

  • Communicate with you;
  • Provide you with information about career opportunities;
  • Provide our Services;
  • Connect you with employers;
  • Allow you to sign contracts with employers;
  • Process and maintain your account registration (where applicable);
  • Provide you with support;
  • Personalize your experience on our Sites.
  • Measure the performance of our Sites and Services;
  • Conduct audits related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with applicable laws and regulations;
  • Improve and monitor the security and integrity of the Sites and Services;
  • Maintain, improve and customize our Sites and Services;
  • Investigate, prevent or take action regarding illegal activities, suspected fraud or violations of our terms of use;
  • Efficiently maintain our business;
  • Comply with applicable law; and
  • Defend our legal rights and the rights of others.

5. HOW WE SHARE PERSONAL DATA

We may share the personal data we collect in the following ways:

  1. With vendors and service providers. We may share information with vendors and service providers who:

    • perform data services on our behalf, such as hosting and managed services;
    • prepare, deploy and analyze advertising content on our behalf; and
    • provide other services on our behalf, such as accounting services, call center services, client relationship management services and other various business services.
  1. To Meet Our Legal Requirements or Exercise Our Rights. We may share information with third parties in the following instances:

    • When we are required to do so by law.
    • In connection with any legal proceedings or prospective legal proceedings.
    • To establish, exercise, or defend our legal rights, including providing information to others for the purposes of fraud prevention.
    • When we reasonably believe the time is appropriate to apply to a court or other competent authority for disclosure of that personal data where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal data.
    • We may share information with other persons or entities as part of our own corporate transactions, such as during financing or any asset sale.
  1. At Your Request.  We will share your personal data when you request or otherwise consent to the disclosures.  For example, if you request that we share your professional information with a healthcare employer, we will share the information you provided to us to share.

6. COOKIES AND OTHER TRACKING TECHNOLOGY

We use tracking technology to: (a) estimate audience size and usage patterns; (b) understand and save your preferences for future visits, allowing us to customize the online experience to your individual needs; (c) advertise new content, events and services that relate to your interests; (d) keep track of advertisements and search engine results; (e) compile aggregate data about notifications, traffic and interactions to resolve issues and offer better online experiences and tools in the future; and (f) recognize when you return to our Sites.

We set some tracking technologies ourselves and others are set by service providers. We use Cookies set by service providers to provide us with useful information to help us improve our sites, to conduct advertising, and to analyze the effectiveness of advertising. 

Google Analytics
We may use Google Analytics (or other such services), a web analytics service provided by Google, Inc. Google Analytics uses Cookies or other tracking technologies to help us analyze how users interact with the Sites and Services, compile reports on their activity, and provide other services related to their activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a returning visitor, and any referring website. The technologies used by Google Analytics do not gather information that personally identifies you. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google’s privacy policies. How To Opt-Out. 
Cookies and other tracking technologies can be blocked by changing your settings to refuse all or some cookies.  You may opt out of certain cookies by visiting our website.  If you choose to block all cookies (including essential cookies) you may not be able to access all or parts of the Sites.  You can find out more about cookies and how to manage them by visiting www.AboutCookies.org.  You can also learn about which third parties have currently enabled cookies for your browser or mobile device and how to opt-out of some of those cookies by accessing the Network Advertising Initiative’s website or the Digital Advertising Alliance’s website. 7. UNIVERSAL OPT OUT MECHANISMS

We do not engage in “sales,” or “shares,” or “targeted advertising” as those terms are defined under applicable laws and our Sites do recognize the Global Privacy Control(“GPC”) signal. For more information and to download and use a browser supporting the GPC browser signal, click here: https://globalprivacycontrol.org/orgs.  If you choose to use the GPC signal, you will need to turn the feature on for each supported browser or browser extension you use. Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Sites do not currently interpret, respond to or alter the practices when they receive “Do Not Track” signals.

8. SECURITY

When you register for an account with us, you may be required to choose or will be assigned a password which enables you to access our Sites.  You are responsible for keeping this password confidential and for all activity that takes place through your account credentials. Do not share your password with anyone.  If your password is compromised, change your password within your account.  If you believe your account may have been compromised, please notify us immediately.

We take industry standard security measures to protect your information. We also have put into place appropriate agreements and/or procedures with our service providers to ensure that your personal data is treated consistent with applicable data privacy and security laws. Unfortunately, the transmission of information via the internet is not completely secure.  Although we will do our best to protect your personal data, we cannot and do not guarantee the security of your data. 

9. CHILDREN’S PRIVACY

The Sites are not intended for children under sixteen (16) years old.  We do not intentionally collect any personal data from consumers under the age of sixteen (16) years of age.  We do not sell personal data of any individuals, including individuals under the age of sixteen (16) years. 

10. LINKS TO THIRD-PARTY SITES

Our Sites may contain links to other websites and companies that may be of interest to you.  If you click on any of those links, you will leave our Sites.  We are not responsible for third-party websites.  Therefore, please consult the terms of service and privacy policies of those sites when you visit them.

11. YOUR STATE PRIVACY RIGHTS AND ADDITIONAL DISCLOSURES

Depending on the state in which you reside, you may have certain privacy rights regarding your personal data. If you are a California resident, please see our “Notice to California Residents” section below.

For other state residents, your privacy rights may include (if applicable):

  • The right to confirm whether or not we are processing your personal data and to access such personal data;
  • The right to obtain a copy of your personal data that we collected from and/or about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another controller without hindrance, where the processing is carried out by automated means;
  • The right to delete personal data that we collected from and/or about you, subject to certain exceptions;
  • The right to correct inaccurate personal data that we maintain about you, subject to certain exceptions;
  • The right, if applicable, to opt out of the processing of your personal data for purposes of (1) targeted advertising; (2) the “sale” of your personal data (as that term is defined by applicable law); and (3) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you;
  • If we are required by applicable law to obtain your consent to process sensitive personal data, the right to withdraw your consent; and
  • The right not to receive discriminatory treatment by us for the exercise of your privacy rights.


If you have questions or would like to exercise your rights, you may contact us via email or webform.  Our email address and webform link are provided in Section 15 below.  If legally required, we will comply with your request upon verification of your identity and, to the extent applicable, the identity of the individual on whose behalf you are making such request. To do so, we will ask you to verify data points based on information we have in our records. If we do not take action regarding your request, you may appeal our decision by submitting an appeal through our webform.

12. PRIVACY NOTICE TO CALIFORNIA RESIDENTS

This Privacy Notice to California Residents (“CA Notice”) is only for California residents and supplements the other sections of this Privacy Policy.  This CA Notice explains how we collect, use and disclose your “personal information” (as that term is defined by California law) and how you may exercise your rights under the California Consumer Privacy Act (“CCPA”).  If you are not a California resident, this does not apply to you.

  1. YOUR RIGHTS.  As a California resident, you have the following rights.

RIGHT TO KNOW

You have the right to request that we disclose to you the personal information we collected about you in the 12-month period preceding your request.  This right includes the right to request: (1) specific pieces of personal information we have collected about you; (2) categories of personal information we have collected about you; (3) categories of sources from which the personal information was collected; (4) categories of personal information that we sold or disclosed for a business purpose about you (if applicable); (5) categories of third parties to whom your personal information was sold or disclosed for a business purpose (if applicable); and (6) the business or commercial purpose for collecting or, if applicable, selling your personal information.

RIGHT TO DELETE

You have the right to request that we delete your personal information that we have collected from you, with some exceptions.  Note that if you request that we delete your information, we may be unable to provide you with certain offers or services.

RIGHT TO CORRECT

You have the right to correct inaccurate personal information we maintain about you.

RIGHT TO OPT OUT OF SALE

You have the right to say no to the sale of personal information.  The CCPA defines “sell” to mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a California resident’s ppersonal information to another business or a third party for monetary or other valuable consideration.  We do not sell personal data or share personal data for cross contextual behavioral advertising.

RIGHT TO LIMIT PROCESSING OF SENSITIVE PERSONAL INFORMATION

If we use or disclose sensitive personal information for purposes other than those allowed by the CCPA and its regulations, the right to limit our use and disclosure. 

RIGHT TO NON-DISCRIMINATON

You have the right to non-discrimination for exercising your CCPA rights.  This means we cannot deny you goods or services, charge you different prices, or provide a different level of quality of goods or services just because you exercise your rights under the CCPA.

  1. HOW TO EXERCISE YOUR RIGHTS.  We do not sell personal information and we do not discriminate in any way for exercising CCPA rights.  We have provided a list of the categories of personal information we have collected in the preceding 12 months below, as well as a list of the categories of personal information we have shared with others for business purposes.  If you have questions or would like to further exercise your rights, you may contact us via email or webform.  Our email address and webform link are provided in Section 15 below. Please note that to protect your information, we may need additional information from you to verify your identity before processing your request.  Under the CCPA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. We reserve the right to request that your authorized agent have written permission from you to make requests on your behalf and may need to verify your authorized agent’s identity.
  1. NOTICE AT COLLECTION OF PERSONAL INFORMATION.  To provide you with our Sites and Services, we collect and process information about you, including in some cases, personal information.  To comply with the CCPA and to assist you in understanding our data collection and protection practices during the 12 months prior to the Effective Date of this Privacy Policy:

  • Categories of Consumer Personal Data.  We have listed the types of consumer personal information we have collected in Section 3 “Types of Personal Data We Collect” above. 
  • Purpose for Collection.  We have identified the purpose for which we collect consumer personal information in Section 4 “Why We Collect and How We Use Your Personal Data” above.  We may also collect personal information for the following business purposes:
    • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality  of  ad  impressions,  and  auditing  compliance  with  this  specification  and  other standards.
    • Helping to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for these purposes.
    • Debugging to identify and repair errors that impair existing intended functionality.
    • Performing  services,  including  maintaining  or  servicing  accounts,  providing  customer service, processing or fulfilling orders and transactions, verifying customer information, or providing similar services.
    • Undertaking internal research for technological development and demonstration.
    • Undertaking  activities  to  verify  or  maintain  the  quality  or  safety  of  a  service,  and  to improve, upgrade, or enhance the service.
    • Advancing our commercial or economic interests, such as by inducing another person to buy,  rent,  lease,  join,  subscribe  to,  provide,  or  exchange  products,  goods,  property, information,  or  services,  or  enabling  or  effecting,  directly  or  indirectly, a  commercial transaction.
  • Sources of Personal Information.  As set forth in Section 3 “Types of Personal Data We Collect” above, we receive personal information from you, your device(s), and from our service provider and employer partners.
  • Children’s Personal Information.  We do not knowingly collect personal information of consumers under 16 years of age and we do not sell personal information of consumers under 16 years of age.
  • Sensitive Personal Information.  We do not use sensitive personal information (as defined in the CCPA) for purposes other than those the CCPA and its regulations allow for.
  • Retention of Personal Information.  We retain personal information for as long as necessary to fulfill the purposes for which we collect it, such as to provide you with the service you have requested, and for the purpose of satisfying any legal, accounting, contractual, or reporting requirements that apply to us.
  • Sale of Data.  We do not sell personal information and have not sold personal information in the twelve (12) months preceding the Effective Date/Last Updated date of this Privacy Policy.
  • Disclosure/Sharing of Data.  We have identified why and to what categories of entities we disclose consumer personal information for our business purposes in Section 5 “How We Share Personal Data” above.  The below table identifies the categories of personal data that we disclosed for a business purpose in the 12 months prior to the Last Updated Date of this Privacy Policy.

13. DATA RETENTION

We will store your personal data for as long as: (a) you maintain an account with us; (b) you continue using our Sites and Services; (c) your personal data is stored in our back up servers and/or services; (d) in accordance with our retention policies and schedules; and (e) as long as we are legally required to retain the personal data.

14. ACCESSIBILITY
